Resolving Organizational Conflict

Family Businesses

Family businesses involve a unique set of complex interpersonal dynamics which can significantly impact decision making and other aspects of commercial functioning. TMG has worked with dozens of family businesses over the years, assisting them to develop realistic, healthy and productive strategies for optimizing their business operations within this special context.

Partnership Dissolutions

Over the years, TMG has assisted, through both mediation and facilitation, in the restructuring or dissolution of numerous law firms and other business partnerships. These disputes typically involve complex financial negotiations in an atmosphere that is highly charged emotionally, often in the context of significant, longstanding personal relationships.

Designing Systems to Resolve Disputes

Court-based ADR

TMG, in conjunction with the Massachusetts Office of Dispute Resolution (MODR), worked with the Massachusetts Superior Courts to design and implement the courts' first mediation programs.

Design of Health Plans' Dispute Resolution Systems

With a grant from the Robert Wood Johnson Foundation (RWJ) and in collaboration with New York University, TMG developed the Dispute Resolution in Managed Care: a Modular Self Assessment Protocol, a tool for assessing conflict resolution systems in managed care organizations (MCOs). TMG later implemented and evaluated the Protocol at several MCOs nationwide.

Systems for Resolving Conflicts Within Organizations

TMG worked with the Harvard Medical School and School of Dental Medicine to develop a program to handle conflicts arising within the organization. TMG's intervention included systems design consultation and intensive staff training in negotiation and mediation skills and theory.

Case Consultation/Negotiation Coaching

For individual clients, TMG has provided case consultation including evaluation of the merits and strategies for case management. These consultations have proved valuable throughout the process, from the early stages of a business transaction through the litigation and appellate phases of a complex commercial dispute.
