TMG has undertaken a variety of projects to help organizations analyze how they handle disputes and how they might handle them more effectively. Through systems analysis and design, TMG can help institutions assess their existing mechanisms and design new processes for dealing with differences and conflicts, which promote both healthy handling of conflict within the institution and organizational learning about the sources of conflict for overall improvement to the quality of services provided.
Brief descriptions of some examples of that work follow:
Massachusetts Superior Courts:
TMG was hired, in partnership with the Massachusetts Office of Dispute Resolution, to provide the initial design and implementation of mediation programs for the Massachusetts Superior Courts in Suffolk and Norfolk Counties as well as at the Middlesex Multi-Door Court House. This long-term endeavor entailed the creation of the first mediation program used in the Massachusetts Courts. Working with both the Courts and the Executive branch, TMG set up an administrative structure, designed the process by which the Court selected its panel of mediators, and designed and helped to implement systems for both the evaluation and mentoring of Court mediators.
New Hampshire Court Mediation Programs
Following its successful work with the Massachusetts Courts, TMG was hired to serve as a consultant in the design of a mediation program for the New Hampshire Courts. Over a number of years, TMG provided a series of negotiation and mediation trainings for mediators in the New Hampshire Superior Court and provided advanced negotiation training to the New Hampshire Public Defenders.
Massachusetts Department of Environmental Protection
Working through the Massachusetts Office of Dispute Resolution, TMG designed a system to alleviate the backlog of cases on wetlands and other land use disputes for the Massachusetts Department of Environmental Protection (DEP). TMG was responsible for the design and implementation of a statewide panel of Environmental mediators and, through the Boston Bar Association, developed a comprehensive program to train a panel of environmental attorneys to mediate Wetlands disputes. In addition, TMG provided mediation and negotiation training to Administrative law judges, lawyers and technical staff of the Massachusetts DEP.
Israeli Trial Court ADR Program
TMG served as a consultant in the development of legislation to establish the use of ADR in the Israeli courts and in the subsequent design and implementation of ADR programs for the trial courts of Israel.
