Civil and Family Mediation
David is a seasoned litigator, trial attorney, and appellate attorney with nearly thirty years of experience resolving high-stakes litigation in and outside of state and federal courts in Massachusetts and various other jurisdictions across the United States. In addition to joining TMG’s mediator roster, David maintains a litigation practice as a Principal Shareholder of Greenberg Traurig, LLP. At Greenberg, he specializes in resolving unfair business practices disputes, in individual and putative class-action settings, partnership and LLC disputes, false claims act disputes, construction disputes, and general business-to-business disputes. He has been named by Boston Magazine as a “Top Lawyer” for class actions and by Massachusetts Lawyers Weekly as a “Go To Lawyer” for business and commercial litigation over multiple years. His background representing clients in high-stakes litigation, including bet-the-company litigation, gives him a strong command of the legal and strategic dynamics impacting litigation-risk assessment that often helps facilitate effective dispute resolution.
In addition to his litigation practice, David has significant experience in negotiation and alternative dispute resolution, regularly helping parties resolve matters outside of arbitration and litigation in the court system. He holds an LL.M. in Dispute Resolution and has been certified as a mediator by the National Association of Certified Mediators (NACM), which reflects his formal education and training in mediation theory, negotiation strategy, and conflict management and resolution techniques.
His mediation approach is grounded in core mediation principles, including neutrality, party self-determination, confidentiality, risk assessment, and informed decision-making. David calls on both facilitative and evaluative techniques to help parties clarify their interests, test assumptions, and realistically assess whether litigation represents the parties’ best or worst alternative to a negotiated agreement. Through active listening and careful issue framing, he works to uncover underlying concerns that may not be immediately apparent and create a space for productive dialogue. Drawing on his experience, education, and training, David is committed to maintaining a professional, respectful mediation environment where all participants are heard and engaged. His combination of legal insight, litigation risk assessment, balanced judgment, and dispute resolution education and training enables him to effectively facilitate resolution even in the most challenging circumstances.
